CPC's favored area of practice is representing land trusts and landowners in conservation easement negotiation and conservation easement drafting. CPC also represents land trusts and landowners in negotiating and drafting purchase and sale agreements for conservation easement and fee title transfers. CPC can also assist in complex closings.

CPC represents both land trusts and landowners. Regarding representation of landowners, CPC is experienced in representing farmers and cattle ranchers through working lands conservation easements.

CPC's scope of representation has now expanded to assisting land trusts and landowners develop and market carbon offsets. Carbon offsets can be achieved in many ways, from avoided deforestation to planting trees. Adding a carbon offset program to a donated or purchased conservation easement can increase the monetary benefits available to the landowner.

CPC provides a number of institutional services such as: (1) formation of 501(c)(3) nonprofit corporations or other business entities such as limited liability companies (simply click here to go to the corporation formation page); (2) achieving compliance with LTA accreditation and LTA standards; (3) advising land trusts on institutional and board member liability and risk management strategies (see e.g., "Key Facts About Insurance and Legal Liability.") For group memberships, CPC also gives six presentations a year on land trust related issues. For example, CPC is beginning 2007 by sponsoring three panels on conservation easements at the University of Oregon School of Law Public Interest Environmental Law Conference (held in the first week of March, 2007).

CPC Attorney Bio Conservation & Preservation Counsel attorney Jim Olmsted received his B.A. and M.A. from the University of Nevada at Reno. Jim was awarded his Master's Degree for his scholarship in the area of psychology and the law, and he has had extensive experience with trial consulting involving complex litigation. Jim received his J.D. from the University of California at Davis School of Law in 1987. During law school, Jim interned with Judge Edward C. Reed at the Federal District Court for the District of Nevada. After graduation from law school, Jim clerked for Justice Charles E. Springer on the Nevada Supreme Court. Jim is an active member of the state bar associations of California, Nevada, Oregon and Washington. He has been practicing zoning, land use, real estate and conservation law for eighteen years. In addition to his legal practice, Jim has taught on the faculty of the University of Oregon School of Law and has a wealth of experience in the public interest sector. Jim has served on the board of directors of the Friends of the Columbia Gorge, the Friends of the Evergreen Highway, the Heritage Trust of Clark County, the Historic Preservation Advisory Commission of Truckee, California, and the Truckee Donner Land Trust. Of these organizations, Jim has served as vice-president of the Friends of the Evergreen Highway and as president of the Truckee Donner Land Trust. Jim is a frequent speaker and writer on topics relating to conservation easements, land preservation and land protection. In addition to his academic and legal pursuits, Jim is an avid outdoorsman. He has hiked the entire 222 miles of the John Muir Trail in California's high Sierra, and has backpacked extensively in Washington's North Cascades, and the Sawtooth Mountains and the Frank Church Wilderness in Idaho. Jim has also biked the Seattle to Portland road race and has twice competed in Oregon's Hood to Coast race, the largest relay race in North America. For Jim's CV, click here. |
